BV LOXXER – Privacy Statement

BV LOXXER (hereinafter referred to as “LOXXER”) issues this Privacy Statement with the purpose of transparently informing visitors to the website www.loxxer.com and/or users of the “MyLoxxer” application (both the visitor and the user hereinafter referred to as “data subject”) about the way in which the personal data of the data subject is processed.

When the data subject uses the MyLoxxer application, they will notice that LOXXER places information on the device and that information is collected. The information concerned is described in point 1. The data subject is always asked to give explicit consent to the placement and/or use of this information. It should be understood, however, that if this consent is not given, certain functionalities cannot be used. The data subject can always withdraw their consent by changing the settings for the MyLoxxer application.

Why do we process personal data?

LOXXER processes personal data for various purposes, depending on the reason for corresponding with LOXXER.

MyLoxxer registration

When the data subject registers, their name and email address are processed. This personal data is processed to facilitate access to and use of the website. This personal data is processed to facilitate access to and use of the MyLoxxer application and for the performance of the agreement.

Invoicing and payment

In the context of payment for the use of the MyLoxxer application, LOXXER processes the following personal data of the data subject: contact details, the company name or legal entity on whose behalf the data subject acts, address details, and financial data.

How long do we retain personal data?

LOXXER retains the personal data of the data subject for as long as reasonably necessary to achieve the purposes mentioned above or to comply with a legal obligation incumbent on LOXXER. For example, invoices must be kept for a certain period in connection with accounting obligations.

LOXXER always processes the personal data of the data subject with due care and in compliance with the relevant data protection legislation. As such, LOXXER never shares personal data with third parties, unless this proves necessary for the performance of the agreement or the provision of services.

LOXXER does not transfer personal data to countries located outside the European Union or the European Economic Area.

LOXXER does not make decisions based on automated decision-making, including profiling.

Security measures

LOXXER undertakes to use its best efforts to take all reasonable measures to ensure the protection of personal data so that it is protected against misuse, loss, and unauthorized access. These measures are always based on the current state of the art.

The rights of the data subject

The data subject has various rights regarding the personal data processed by LOXXER. The data subject can exercise these rights by contacting LOXXER via the contact details listed in point 9. In the context of the identification requirement, LOXXER may request the data subject to provide a copy of their identity card.

Right of access

If the data subject wants to know which personal data is being processed and for which purposes, they can contact LOXXER. The data subject has the right of access to the following personal data and information:

The data subject can request that any incorrect, inaccurate, or irrelevant personal data be corrected or that the data be amended or deleted. Any recipients of the personal data will, to the extent possible, be informed of the rectification.

Right to restriction

Where the data subject has valid grounds to do so, they can request that the processing of personal data be restricted. For example, because they dispute the accuracy of the data.

Right to object

Where the processing of personal data is based on a legitimate interest or forms part of the performance of a task carried out in the public interest or in the exercise of official authority, the data subject can object to the processing of personal data on reasonable grounds.

Right to data portability

If LOXXER processes personal data based on (explicit) consent or in the context of the performance of the agreement, the data subject can request LOXXER to provide the personal data supplied to the data subject in a structured, commonly used, and machine-readable format, or to have it transferred to another data controller.

Right to withdraw your consent

Where the processing of personal data by LOXXER is based on (explicit) consent, the data subject has the right to withdraw this consent at any time. Withdrawal of consent does not, however, affect the lawfulness of processing carried out prior to the withdrawal of consent.

Right to lodge a complaint

The data subject has the right to lodge a complaint with the Data Protection Authority if they have a complaint about the use of their personal data by LOXXER.
